If you’ve been served a party wall notice by your neighbour, it’s important to understand your rights and responsibilities under the Party Wall etc. Act 1996. Here’s what you should do:
1. Read the notice carefully
The notice should explain what your neighbour plans to do, such as building work on or near a shared (party) wall, excavating near your property, or constructing a new wall on a boundary. The notice must give you at least 1 or 2 months’ notice, depending on the type of work. Ensure it includes the necessary details, such as the nature of the work, when it is planned to start, and how it may affect you.
2. Decide how to respond
You have three options:
• Consent to the works: If you’re satisfied with the plans and don’t foresee any issues, you can give your written consent within 14 days of receiving the notice.
• Dissent and appoint a surveyor: If you have concerns or want additional safeguards, you can formally dissent and appoint a surveyor. Your neighbour is obligated to cover the reasonable costs of your surveyor.
• Dissent and agree on a joint surveyor: Both parties can agree to appoint one surveyor to act impartially for both sides.
3. Take no action
If you don’t respond within 14 days, it’s treated as a dissent under the Act, and a surveyor (or surveyors) will need to be appointed to draw up a Party Wall Award.
4. Understand the Party Wall Award process
If you dissent, a Party Wall Award will be drawn up by the surveyor(s). This document outlines the scope of the works, how they’ll be carried out, and any protective measures for your property. It may also include a schedule of condition, which documents the state of your property before work begins to help resolve any disputes about damage later.
5. Seek professional advice if needed
If you’re unsure about the notice or the implications of the proposed works, consulting a party wall surveyor early can provide clarity. They can ensure your rights are protected and help avoid disputes. It’s essential to engage constructively with the process to ensure the works proceed smoothly while safeguarding your property.
