Semis, terraces and flats by the river

Staines-upon-Thames, Shepperton, Ashford, Stanwell, Sunbury-on-Thames and Slough grew mainly in the twentieth century. The streets are mostly interwar and postwar semis and short terraces, with blocks of flats near the centres and some riverside houses. Much of the housing is modest in plot size, so neighbours are close and almost every project touches a shared wall.

What triggers a party wall notice in Staines

  • Loft conversions and dormers in semis and terraces, where steel beams bear on the party wall. See loft conversions.
  • Side and rear extensions that tie into the shared wall or go up to the boundary. See rear and side extensions.
  • Garage conversions and extensions over garages, where a shared wall is raised or loaded. See Section 3 notices.
  • Work to flats with separate entrances or staircases, where floors and ceilings can be party structures.
  • New building on gap sites, where a new house or block goes up against an existing one.

The Thames valley

Many of these towns lie on low ground by the river. Flood risk and groundwater are planning and building control matters, but a basement, pool or deep foundation near the river is the kind of excavation the surveyors will look at carefully. If your property is close to the water, ask the engineer how groundwater is to be handled.

Two councils, one Act

Staines, Shepperton, Ashford, Stanwell and Sunbury come under Spelthorne Borough Council for planning, and Slough under Slough Borough Council. The party wall notices and the timetable are the same in both.

Staines, Shepperton and Slough questions

Do you cover Slough, which is in Berkshire?

Yes. The Party Wall etc. Act 1996 applies in the same way across England and Wales, so the notices, periods and process are the same in Slough as in Staines.

I own a flat in Staines. Does the Act apply to me?

It can. Where flats have separate entrances or staircases, the floor and ceiling between them can be party structures, and work to them, such as cutting in beams or taking out part of a floor, can need a notice. Where flats share a communal entrance and stair it is less clear, so ask us. Your lease may also require the freeholder’s consent, which is separate from the Act. See flats, leaseholders and tenants.

My house is near the river. Will flood risk affect the party wall notice?

Not the notice itself. Flood risk is a planning and building control matter. It can affect how a deep excavation is designed, and the surveyors will want to see how it is dealt with.
