Villas by the river, semis inland

Kingston and Surbiton are known for larger Victorian and Edwardian houses, including villas that have been divided into flats, and for a core of older terraces around Norbiton and the town centre. Further out, Tolworth, New Malden, Motspur Park and Chessington are mainly interwar suburbs of semis and short terraces.

The Thames and the Hogsmill run through the borough, so some parts are low-lying and prone to flooding.

What needs a party wall notice in Kingston

  • Extensions and loft conversions in the semis and terraces. See loft conversions.
  • Alterations in converted villas, where the other flat owners and the freeholder may all have a stake.
  • Basements and large extensions in the bigger houses, which are deep excavations. See basements and underpinning.
  • Side returns and boundary walls in the older terraces. See Section 1 notices.
  • Redevelopment of plots, where a new house or block goes up beside an existing one.

Planning in Kingston is separate from the Act

The Royal Borough of Kingston upon Thames is the planning authority. Many parts of the borough are conservation areas, which affect planning, not the notices under the Act. Flood risk also matters to planning and building control. None replaces a party wall notice.

Kingston, Surbiton and New Malden questions

My Surbiton house is a converted villa. Who counts as an adjoining owner?

The owners of the property next door, and in some cases the other owners in your own building, depending on how the building is arranged and what the work affects. The freeholder is often also an owner for the purposes of the Act. We can tell you who to serve from the title information. See flats, leaseholders and tenants.

Do I need a notice for a rear extension on a semi in New Malden?

If the extension will be built on the boundary, a Section 1 notice is needed. If it cuts into the shared wall, a Section 3 notice. If the foundations will be deeper than your neighbour’s within 3 or 6 metres, a Section 6 notice. Many extensions need more than one. See rear and side extensions.

Does living near the Thames affect party wall work?

Not the notices themselves. Flood risk and groundwater affect planning, building control and the design of any deep excavation, and the surveyors will look at how that has been dealt with.
