From Penge terraces to Chislehurst’s large plots

Bromley, Beckenham and Penge have Victorian and Edwardian terraces and villas, with plenty of houses divided into flats. Orpington, Petts Wood and West Wickham are mostly interwar suburbs, with semis, detached houses and some distinctive planned estates. Chislehurst and the south of the borough have larger houses on bigger plots, and Green Belt land beyond. Parts of Bromley, Beckenham and Chislehurst are conservation areas.

What needs a party wall notice in Bromley

  • Side extensions and garage conversions on semis with side passages, where a new wall goes on or near the boundary. See rear and side extensions.
  • Loft conversions and dormers, where steels bear on the party wall. See loft conversions.
  • New houses and annexes in back gardens, which put deep foundations near existing neighbours.
  • Terrace and villa work, including chimney breast removal and conversions to flats. See chimney breast removal.
  • Basements in the larger houses. See basements and underpinning.

Large plots do not mean no notice

Wide plots make many owners think they are well clear of the neighbours. The Act’s tests are about the distance to the neighbour’s building or structure and the depth of the dig, so it is worth measuring. A garage, outbuilding or garden wall counts as a structure. See does the Act apply to a detached house.

Planning in Bromley is separate from the Act

The London Borough of Bromley is the planning authority. Planning permission, any conservation area rules and building regulations approval are separate from the Act. A notice does not replace them.

Bromley, Beckenham and Orpington questions

I want to extend my semi sideways to the boundary. What notice do I need?

If the new flank wall will stand on the line of junction, a Section 1 notice is needed. If it is set back but its foundations will be deeper than your neighbour’s and within 3 metres of their house, a Section 6 notice is needed. Many side extensions need one or the other. See Section 1 notices.

My neighbour is building a new house in their back garden. What protection do I have?

If the work is covered by the Act, you can have a surveyor, a schedule of condition of your property and an award setting working hours, protection and monitoring. A new house close to your boundary is often a Section 6 job. Do not consent without advice. See help for neighbours.

Does a dormer need a party wall notice?

A dormer built entirely on your own roof does not, but the steel beams that support it often bear on the party wall, and then a Section 3 notice is needed. It depends on the structural design.
