Terraces, villas and flats

Streatham, Clapham, Brixton, Stockwell and West Norwood are largely Victorian and Edwardian. There are long terraces of family houses, large villas and mansion blocks, and a great number of conversions into flats. Streatham Vale and parts of Streatham have interwar housing as well.

The result is that a single building often has several owners, and the party wall question is rarely only “what does the house next door want to do?”.

What needs a party wall notice in Streatham

  • Loft conversions and rear extensions in the terraces, with two neighbours to serve. See loft conversions and rear and side extensions.
  • Structural alterations in flats, such as cutting steel into a floor or ceiling or into a shared wall, which can need a notice where the flats have separate entrances or staircases.
  • Chimney breast removal in main rooms, which can affect the flat above or below. See chimney breast removal.
  • Basements and lower-ground floors in larger houses. See basements and underpinning.

Flats: the Act and your lease

For flats, two sets of rules run side by side. The Act decides whether a notice is needed and what the award says. The lease decides whether you may do the work at all and whether the freeholder must consent. Getting the freeholder’s consent does not replace a notice, and serving a notice does not replace the freeholder’s consent.

Planning in Streatham is separate from the Act

The London Borough of Lambeth is the planning authority for most of this area, and the London Borough of Wandsworth for parts such as Clapham Junction. Many streets are in conservation areas. Planning permission and building regulations approval are separate from the Act.

Streatham, Clapham and Brixton questions

Does the Act apply to a flat in a converted house?

It depends on how the building is arranged. The Act covers floors and walls that separate parts of a building approached by separate staircases or entrances. Flats with their own front doors are more clearly covered than flats that share a communal entrance and stair. Your lease will also set rules about alterations. Ask us about your case. See flats, leaseholders and tenants.

Who are the adjoining owners in a building with several flats?

Owners of the property next door, and in some cases other owners in the same building, as well as the freeholder. A Land Registry search shows who they are, and we do it as part of our notice service.

My upstairs neighbour is converting the loft. Do I have a say?

If the work is covered by the Act, you may be an adjoining owner entitled to a notice. Your lease and the freeholder’s consent are separate matters. Call us and we will explain where you stand.
